Warranty

MACHINE WARRANTY

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.  You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.  You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

DDM Laser Pty Ltd (ABN 78 616 488 772) (“DDM LASER”) provides the following warranty in relation to each new individual machine it supplies to Purchasers (“Machine”).

The benefits of this warranty are in addition to any rights and remedies imposed by Australian State and Federal legislation that cannot be excluded.  Nothing in this warranty is to be interpreted as excluding, restricting or modifying any State or Federal legislation applicable to the supply of goods and services which cannot be excluded, restricted or modified.

WARRANTY

DDM LASER warrants that, subject to the exclusions and limitations below, all parts of the manufacture or assembly of the Machine carried out by DDM LASER will be free from defects in materials and workmanship for a period of (a) 12 months from date of delivery; or (b) 2,000 hours of use, whichever occurs sooner.

This warranty is not transferable to a subsequent Purchaser if the Machine is sold by the original Purchaser during the warranty period.

If a defect appears in DDM LASER’s manufacture or assembly of the Machine before the end of the warranty period and DDM LASER finds the Machine to be defective in materials or workmanship, DDM LASER will, in its sole discretion, either:

(a)          replace or repair the Machine or the defective part of the Machine free of charge; or

(b)          cause the Machine or the defective part of the Machine to be replaced or repaired by a qualified repairer free of charge.

DDM LASER reserves the right to replace defective parts of the Machine with parts and components of similar quality, grade and composition where an identical part or component is not available.

Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired.  Refurbished parts may be used to repair the goods.

WARRANTY CLAIMS

  1. If a fault covered by warranty occurs, the Purchaser must first contact DDM LASER at the contact address listed below.
  2. Any warranty claim must be accompanied by:

(a)          proof of purchase;

(b)          full details of the alleged defect; and

(c)          appropriate documentation (such as historical and maintenance records and Machine logbooks).

 

  1. The Purchaser must make the Machine available to DDM LASER or its authorised repair agent for inspection and testing. If such inspection and testing finds no defect in the Machine, then the Purchaser must pay DDM LASER’s usual costs of service work, testing and evaluation.
  2. If any transport of the Machine or part of the Machine is required in order for DDM LASER or its authorised repair agent to inspect, test, repair or replace the Machine, then the Purchaser must bear the cost of the transport of the Machine to and from DDM LASER or the authorised DDM LASER repair agent, and all insurance of the Machine.

EXCLUSIONS

The warranty will not apply where:

(a)  the Machine has been repaired, installed, transported, altered or modified by someone other than DDM LASER or an authorised DDM LASER agent;

(b)  the alleged defect in the Machine is within acceptable industry variances;

(c)  DDM LASER cannot establish any fault in the Machine after testing and inspection;

(d)  the Machine has been used other than for the purpose for which it was designed;

(e)  a Machine logbook has not been correctly maintained;

(f)   the Technical Specifications, as provided to the Purchaser, have not been complied with;

(g)  the defect in the Machine has arisen due to the Purchaser’s failure to properly use, operate and maintain the Machine in accordance with DDM LASER’s instructions, recommendations or specifications including applicable maintenance schedules;

(h)  the Machine has been subject to abnormal conditions, including environment, temperature, water, fire, humidity, pressure, stress or similar;

(i)   the defect has arisen due to abuse, misuse, neglect or accident; or

(j)   unauthorised parts or accessories have been used on or in relation to the Machine.

The warranty does not extend to consumables, damage or defects caused by normal wear and tear.

LIMITATIONS

DDM LASER makes no express warranties or representations other than set out in this warranty.

The repair or replacement of the Machine or part of the Machine is the absolute limit of DDM LASER’s liability under this express warranty.
